Duhaime's Law Dictionary

Mixed Blood Definition:

Persons of half, or more or less than half, Indian blood.

Related Terms: Metis, Indian, Mestizo, Mulatto

In the 1991 edition of the Corpus Juris Secundum, the authors wrote:

"The term mixed bloods, as used in treaties and statutes, has been held to include persons of half, or more or less than half, Indian blood, derived either from the father or from the mother."

As the Corpus Jurus also points out, a person of mixed blood, though often held to be an Indian within the meaning of a statuite, is also often excluded from the definition of Indian.

In Canadian native law, the term Metis is often preferred.
